Previously, the bare metal defense protected manufacturers of products that required asbestos-containing materials to be used. The products themselves did not contain asbestos - but to be effectively used, they required asbestos-containing materials.

In Air and Liquid Systems Corp v. DeVries, the Supreme Court ruled in a six to three decision to hold these manufacturers accountable for negligence.
